You must be over the age of 18 to use Climb Above Fear’s services.

Climb Above Fear will not be held liable for any failures or lack of success, whether perceived or actual.

We hold the right to make changes to these terms

These terms may be altered from time to time. Every time you wish to use our services, please check these terms to confirm you understand the terms that apply at that time. These terms were most recently updated on 28th February 2022.

We may update and/or modify our website from time to time to reflect changes to our products or services, our users’ needs and our business priorities.

We may suspend or withdraw our website

We do not guarantee that our website, or its content, will always be available. Climb Above Fear may suspend, withdraw or restrict the availability of all or any part of our website for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

You must keep your account details secure

You must treat any information you are provided with, including identification codes, passwords and usernames, as confidential. You must not disclose these details to any third party.

Climb Above Fear has the right to disable any user identification codes, passwords or usernames, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you is aware of your personal account details, you must promptly notify Climb Above Fear via the contact form on the homepage.

The use of material on our website

Our website, including all published materials within, is protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off or download extracts of any page(s) from our website for your personal use. You must not modify the materials you have printed off or downloaded in any way. The authors of the content on our website must always be acknowledged.

Climb Above Fear strongly recommends that you seek professional medical advice if you have concerns about your health and wellbeing or those of someone you know.

While we utilise the skills and experience of trained therapists, we do not guarantee any specific outcome from the use of our website or services.

Although we strive to regularly update the information on our website, we make no guarantees, whether expressed or implied, that the content therein is accurate, complete or up-to-date. 

Our responsibility for loss or damage suffered by you 

Our products and services are designed for domestic and private use only. You agree not to use our website, products or services for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will only use your personal information as set out in our Privacy Policy.

We are not responsible for viruses and you must not introduce them

We do not guarantee that our website will be secure or free from bugs or viruses. You are responsible for configuring your computer system, programmes and platform to access our website. You should use your own antivirus software.

Climb Above Fear will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our website will cease immediately.

Rules about linking to our website

You may link to our website, provided you do so in a way that is fair and legal and does not damage our reputation.

You must not link to our website in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not link to our website from any website that is not under your ownership. Our website must not be framed on any other website. The website from which you are linking must comply with all of the standards set out in our Acceptable Use Policy.

We reserve the right to withdraw linking permission without notice.

Our refund policy

The full fee is due upon booking your Climb Above Fear therapy package.

If a session is cancelled by the client (the payer and receiver of the consultation) the following Terms and Conditions apply:

  • Notice of less than 48 hours – no amount will be refunded
  • Notice of 48-72 hours – 50% of full amount will be refunded
  • Notice of more than 72 hours – 100% will be refunded to the client

If a client demonstrates exceptional circumstances as the reason for a cancellation within 48 hours of the booking time, Climb Above Fear may allow for the appointment in question to be rescheduled at no further cost. 

Climb Above Fear reserves the right to cancel sessions at short notice due to personal circumstances. In such scenarios, the client will be offered a rescheduled appointment or a full refund. 

Information provided by Climb Above Fear is intended as advice related to acrophobia and should not be used as a substitute for professional medical advice from a GP or other medical expert.

Climb Above Fear’s services are carried out to the best of our ability, experience and training. However, we cannot accept responsibility or liability for therapy that does not achieve the desired result following the consultation process.

If the client has an underlying health condition, Climb Above Fear reserves the right to refuse or halt proceedings with the consultation. In such cases the client will be provided with a refund.

Climb Above Fear endeavours to complete all packages, including follow-up support, with the client satisfied that any mutually-agreed goals have been met.

If you wish to make a complaint about Climb Above Fear, our website, products, services, or a member of our team, please contact us immediately and we will do our best to rectify the situation.

Acceptable use policy

You may use this website for your own personal lawful use. You agree and understand that you shall not use this website for any unlawful, illegal, fraudulent or harmful purpose or activity.

You may not:

  • Conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this Website without the express written consent of Climb Above Fear
  • Use this website to transmit or send unsolicited commercial communications
  • Use this website for any purposes related to marketing without express written consent of Climb Above Fear

Breach of this policy  

Failure to comply with this Acceptable Use Policy constitutes a material breach of the website Terms and Conditions and may result in Climb Above Fear taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our website
  • Issue of a warning to you
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach
  • Further legal action against you
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law

The actions we may take are not limited to those listed above. We may take any other action we deem appropriate. 

This agreement will be governed by and interpreted according to the laws of England and Wales. Any disputes arising under the agreement will be subject to the exclusive jurisdiction of the English and Welsh courts.
